PRINCIPLES OF FOREIGNERS LAW

A.
Equality Principle : The Constitution 1982
regulates that foreigners have the same basic rights
and freedoms as citizens with the title of “Basic
Rights and Obligations”. In other words, it is
accepted that everybody has the same basic rights without
considering citizenship.
B.
Mutuality Principle : This principle is carried
out between at least two countries and both of them
entitle citizens of the each other the same rights.
For example, according to the article 35 of the Land
Registry Act, it is possible to acquire a real property
in Turkey for foreigners, if Turkish citizens also have
a right to acquire a real property in the foreign country.
C.
The Most Observed Country Principle : It is
an important principle written in some international
agreements.
D.
Respect For Vested Rights Principle : This
principle’s means that when a foreigner has a
right according to current law, he/she has the same
right even if the law is changed.
